• All product descriptions, images, chemical formulas, specifications, and application information provided on our website are for general informational purposes only and may not reflect the exact characteristics of the product you receive
• Product prices displayed on our website are indicative and subject to change without prior notice based on market conditions, raw material costs, supplier pricing, and other factors
• Final pricing for any order will be confirmed through a formal quotation sent to you via email, WhatsApp, or phone after your inquiry is processed
• All prices are exclusive of applicable GST, shipping charges, handling fees, and any other statutory levies unless explicitly stated otherwise
• We reserve the right to refuse to supply any product without providing any reason, especially in cases where we have concerns about the intended use or the buyer's credentials
• Product availability is subject to stock levels and may vary. We will inform you promptly if a requested product is unavailable and suggest alternatives where possible

3. Orders and Payment

The ordering and payment process at ACS Chemical follows these guidelines:

• Orders are initiated through inquiry submission via our website, phone call, email, or WhatsApp. A formal quotation will be provided before order confirmation
• An order is considered confirmed only when you provide written or verbal acceptance of the quotation and make the required advance payment (if applicable) as per the payment terms specified in the quotation
• We accept payments through bank transfer (NEFT/RTGS), UPI, and other approved payment methods as communicated at the time of order confirmation
• Payment terms may vary based on order value, customer profile, and existing business relationship. Standard terms may include full advance, partial advance with balance on delivery, or credit terms for established accounts
• We reserve the right to cancel any order if payment is not received within the stipulated time frame or if there are concerns about the legitimacy of the order
• All invoices will be generated in compliance with GST regulations and will include applicable tax breakdowns. GST invoices will be provided for all B2B transactions upon receipt of valid GSTIN
• Any dispute regarding billing or payment must be raised within 7 days of invoice date

4. Delivery and Shipping

Delivery of chemical products is subject to the following terms:

• Delivery timelines provided are estimated and not guaranteed. Actual delivery times may vary based on product availability, order size, delivery location, logistics constraints, and unforeseen circumstances
• We deliver across India through our network of logistics partners who are certified for hazardous chemical transportation as per ADR and Indian motor vehicle regulations
• Shipping charges are calculated based on weight, volume, hazard classification, and delivery location. These charges will be included in the final quotation
• Risk of loss and title for the products pass to the buyer upon handover to the logistics partner or upon delivery at the specified address, whichever is applicable as per the delivery terms (Ex-Works, FOR, CIF, etc.)
• The buyer must ensure that someone is available to receive the delivery at the specified address. Failed delivery attempts due to buyer's unavailability may incur additional charges
• We are not responsible for delays caused by natural disasters, government restrictions, strikes, port congestion, customs clearance delays (for international orders), or other force majeure events
• For hazardous chemicals, the buyer must ensure that the delivery location has appropriate storage facilities, safety equipment, and required permissions for receiving and storing such materials

5. Quality and Specifications

We are committed to supplying chemicals that meet the specified grade and purity standards. However, the following terms apply:

• All products are supplied with a Certificate of Analysis (COA) from the manufacturer or our in-house quality lab, specifying the test results and compliance with grade specifications
• Product specifications (purity, concentration, grade) are as per the manufacturer's standards and applicable Indian standards (IS/BIS) where applicable
• Minor variations in appearance, color, or physical form within acceptable limits do not constitute a quality defect and do not qualify for returns
• Quality claims must be raised within 7 days of delivery along with supporting evidence such as test reports from an independent accredited laboratory. Claims raised after this period will not be entertained
• Sample testing, if required, must be arranged before placing a bulk order. Once a bulk order is accepted and delivered, quality disputes will be resolved based on the COA provided with the batch
• We do not guarantee the suitability of any product for a specific application. The buyer is responsible for conducting their own trials and assessments to determine product suitability for their intended use

6. Safety and Handling

• All products are supplied with Material Safety Data Sheets (MSDS/SDS) that contain detailed safety information, hazard identification, first-aid measures, handling precautions, and disposal guidelines
• The buyer must ensure that all personnel handling the chemicals are properly trained, equipped with appropriate personal protective equipment (PPE), and aware of the emergency procedures
• Storage must comply with all applicable factory storage norms, hazardous chemical storage rules, fire safety regulations, and environmental protection guidelines
• ACS Chemical shall not be liable for any injury, illness, death, property damage, or environmental harm arising from the misuse, improper handling, inadequate storage, or negligent disposal of our products
• The buyer must comply with all requirements under the Manufacture, Storage and Import of Hazardous Chemicals (MSIHC) Rules, 1989 (as amended), and other applicable chemical safety regulations
• Any product recall or safety alert information will be communicated to buyers through the contact details provided at the time of purchase

7. Returns and Refunds

Given the hazardous nature of chemical products, returns are subject to strict conditions:

• Returns are accepted only in cases of wrong product delivery, significant quality deviation from the COA specifications, or damaged goods received (with photographic evidence provided at the time of delivery)
• Returns will NOT be accepted for reasons including but not limited to: change of mind, incorrect product selection by the buyer, buyer's inability to store the product properly, or the product not being suitable for the buyer's application

• Return shipping costs for valid returns will be borne by ACS Chemical. The product must be returned in its original, unopened, and undamaged packaging with all seals intact
• Refunds, when applicable, will be processed within 15 working days of receiving and inspecting the returned product. Refunds will be made through the original payment method
• Products that have been opened, used, partially consumed, or stored improperly are not eligible for return under any circumstances
• For custom-ordered or specially sourced chemicals, returns are not accepted unless there is a confirmed quality issue

8. Intellectual Property

All content on the ACS Chemical website, including but not limited to text, graphics, logos, images, product descriptions, chemical data, design elements, software, and the overall website design, is the exclusive intellectual property of ACS Chemical or its licensors and is protected by applicable Indian and international intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website without our prior written consent
• The ACS Chemical logo, name, and brand identifiers may not be used in any manner that could misrepresent affiliation, endorsement, or partnership without explicit written authorization
• Product images shown on the website are representative and may differ from actual product appearance. They are not intended to mislead and should not be considered as exact representations
• Any unauthorized use of our intellectual property may result in legal action seeking injunction, damages, and other remedies available under law

9. Limitation of Liability

To the maximum extent permitted by applicable law:

For any consumer disputes, the provisions of the Consumer Protection Act, 2019 shall apply, and disputes may be referred to the appropriate Consumer Disputes Redressal Commission having jurisdiction.
